Terms of Service

1. Acceptance of Terms
By accessing or using sendusd.to(the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Platform. Your continued use of the Platform constitutes acceptance of any modifications to these Terms.
2. Description of Service
sendusd.tois a software interface that enables users to claim a unique username and receive fiat payments as cryptocurrency. Senders pay via card or other supported methods through MoonPay’s fiat-to-crypto onramp, and recipients receive USDC (a stablecoin) directly in their self-custodied Ethereum wallet. The Platform is a non-custodial software interface only: it does not hold, custody, transmit, exchange, or have access to user funds at any point, and it is not a money transmitter, money services business, broker-dealer, exchange, or financial institution. All fiat-to-crypto conversion, custody, and settlement is performed by MoonPay or other independent third-party providers under their own terms and compliance programs.
3. Eligibility
To use the Platform, you represent and warrant that you:
- Are at least 18 years of age;
- Are not located in, ordinarily resident in, organized under the laws of, or a national of any country, region, or territory that is subject to comprehensive sanctions or embargoes administered by the United States, the European Union, the United Kingdom, or the United Nations, including without limitation Cuba, Iran, North Korea (DPRK), Syria, Russia, Belarus, and the Crimea, Donetsk, Luhansk, Kherson, and Zaporizhzhia regions of Ukraine (collectively, the “Restricted Jurisdictions”);
- Are not, and are not owned (50% or more, in the aggregate) or controlled by, and are not acting on behalf of, any person, entity, or vessel that is identified on the U.S. Office of Foreign Assets Control (OFAC) Specially Designated Nationals and Blocked Persons List (the “SDN List”), the OFAC Sectoral Sanctions Identifications List, the OFAC Non-SDN Menu-Based Sanctions List, the U.S. Department of Commerce Denied Persons or Entity Lists, the UK HM Treasury (OFSI) Consolidated List, the EU Consolidated Financial Sanctions List, the UN Security Council Consolidated Sanctions List, or any other applicable sanctions or denied parties list (collectively, “Sanctions Lists”);
- Will not use the Platform to transact, directly or indirectly, with any person, entity, or jurisdiction identified above, and will not use the Platform on behalf of any such person or entity;
- Will immediately cease using the Platform and notify us if, at any time, any of the foregoing representations becomes untrue or you become subject to any Sanctions Lists or Restricted Jurisdiction; and
- Have the legal capacity to enter into a binding agreement under the laws of your jurisdiction.
These representations are deemed repeated each time you access or use the Platform.
4. Account Registration
To register, you must connect an Ethereum wallet using Sign-In with Ethereum (EIP-4361/SIWE). You may then claim a username that serves as your unique payment link. You are responsible for maintaining the security of your wallet and private keys. You represent that any information you provide is accurate, current, and complete, and that the wallet address you connect is under your lawful control. The Platform is not responsible for any loss resulting from unauthorized access to your wallet.
5. Prohibited Uses
You agree not to use, and not to permit any third party to use, the Platform for or in connection with:
- Money laundering, terrorist financing, proliferation financing, or the funding of any criminal activity;
- Evading, attempting to evade, or facilitating the evasion of sanctions, export controls, or trade restrictions imposed by the United States (including OFAC and the U.S. Department of Commerce), the European Union, the United Kingdom, the United Nations, or any other applicable jurisdiction;
- Transacting with, on behalf of, or for the benefit of any person, entity, or jurisdiction identified on any Sanctions List or located in any Restricted Jurisdiction (each as defined in Section 3);
- Using a virtual private network (VPN), proxy, Tor, false location data, false identity, or any other technology or method to disguise your identity, IP address, or location, or to circumvent geo-blocking, sanctions screening, IP-based access controls, or any other compliance measure implemented by the Platform or its service providers;
- Providing false, inaccurate, incomplete, or misleading information at any stage, including in any onramp, KYC, or identity verification flow operated by MoonPay or another third-party provider;
- Fraud, phishing, scams, or any deceptive practice;
- Any activity that violates applicable local, state, national, or international law, including securities, commodities, tax, consumer protection, anti-bribery, or anti-corruption laws;
- Transactions involving the proceeds of illegal activity, or funds derived from or intended to facilitate any of the foregoing.
6. Compliance with Laws
You are solely responsible for ensuring that your use of the Platform complies with all laws and regulations applicable to you, including but not limited to anti-money laundering (AML) laws, counter-terrorist financing (CTF) laws, know-your-customer (KYC) requirements, export control laws, sanctions and embargo regulations, tax laws, securities laws, and consumer protection laws. You acknowledge that the Platform is a non-custodial software interface and does not provide legal, tax, financial, or compliance advice, and that you are not relying on the Platform for any such advice.
You agree to cooperate fully with any compliance, sanctions, fraud, or law enforcement investigation initiated or supported by the Platform, MoonPay, or any other service provider, and to promptly provide any information, documentation, or certifications reasonably requested. Failure to do so is a material breach of these Terms.
7. Payment Processing
Fiat-to-crypto payment processing, custody of fiat funds during conversion, KYC, identity verification, and sanctions screening of senders are handled by MoonPay (or another independent third-party onramp provider) under its own terms of service and privacy policy. The Platform does not process, hold, or have access to payment card information, bank account details, or any KYC documentation submitted to MoonPay. Once MoonPay converts the fiat payment to USDC and delivers it to the recipient’s wallet, the transaction is final and irreversible on the blockchain. The Platform is not responsible for cryptocurrency price volatility, network congestion, gas fees, failed or delayed transactions due to blockchain conditions, fees charged by MoonPay, or any acts, omissions, decisions, refusals to process, suspensions, holds, or refunds by MoonPay or any other third-party provider. MoonPay’s terms of service and privacy policy apply to all payment processing performed by MoonPay, and you are responsible for reviewing and complying with them.
8. Fees and Subscriptions
The Platform offers tier-based pricing for username registration and service access. Subscription fees are payable in USDC and are non-refundable once confirmed on the blockchain. Pricing, tiers, and features are subject to change. The Platform will make reasonable efforts to notify users of material pricing changes in advance. Failure to renew a subscription may result in the release of your username and loss of access to associated features.
9. Intellectual Property
All content, branding, design, code, and materials on the Platform are the property of sendusd.to or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any Platform materials without prior written consent. Your username does not grant you any intellectual property rights beyond the license to use it on the Platform as described herein.
10. Disclaimers and Limitation of Liability
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
THE PLATFORM DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOU USE THE PLATFORM AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, ITS OPERATORS, AFFILIATES, OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THE PLATFORM’S TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL FEES YOU HAVE PAID TO THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless sendusd.to, its operators, owners, affiliates, and their respective officers, directors, employees, contractors, and agents from and against any and all claims, demands, actions, investigations, proceedings, liabilities, damages, judgments, fines, penalties, losses, costs, and expenses (including reasonable attorneys’ fees, expert fees, and costs of investigation and defense) arising out of or in connection with: (a) your access to or use of the Platform; (b) your violation of these Terms or any representation or warranty herein; (c) your violation of any applicable law or regulation, including any sanctions, export control, anti-money laundering, counter-terrorist financing, tax, or securities law; (d) your violation of any rights of a third party; (e) any inaccurate, false, or misleading information provided by you to the Platform or to MoonPay or any other third-party provider; and (f) any enforcement action, investigation, penalty, or forfeiture imposed on the Platform or any of its affiliates by any governmental, regulatory, or law enforcement authority that relates to or arises out of your use of the Platform. This indemnity survives termination of these Terms.
12. Sanctions, Export Controls, and Restricted Jurisdictions
The Platform implements sanctions and compliance controls, which may include IP-based geo-blocking, wallet address screening against OFAC and other Sanctions Lists, and integration with third-party screening providers. Senders are additionally subject to MoonPay’s independent KYC, identity verification, and sanctions screening. The list of Restricted Jurisdictions and the screening criteria may be updated at any time, without notice, as sanctions regimes, guidance, or risk assessments change.
The Platform reserves the absolute right, in its sole discretion and without prior notice or liability, to: (a) refuse, suspend, delay, reverse where technically possible, or terminate any transaction, account, username, subscription, or access to the Platform; (b) block, freeze, or reject any wallet address; (c) report any user, transaction, or activity to OFAC, FinCEN, the U.S. Department of Justice, the U.S. Department of Commerce, the UK OFSI, EU competent authorities, or any other law enforcement, regulatory, or governmental authority; and (d) cooperate with and disclose information to such authorities and to MoonPay or other service providers, where the Platform reasonably believes such action is necessary or advisable to comply with sanctions, export control, anti-money laundering, or other applicable laws, or to protect itself, its operators, affiliates, users, or third parties.
You represent, warrant, and covenant on a continuing basis that (i) you are not a Sanctioned Person and are not located in, ordinarily resident in, organized under the laws of, or a national of any Restricted Jurisdiction; (ii) the funds and wallet you use in connection with the Platform are not derived from, and will not be used in connection with, any activity that violates sanctions, export control, anti-money laundering, or other applicable laws; (iii) you will not use the Platform to provide any benefit, directly or indirectly, to any Sanctioned Person or Restricted Jurisdiction; and (iv) you will not seek to circumvent any compliance measure of the Platform or of MoonPay, including by using a VPN, proxy, false identification, or third-party intermediaries. Each access or use of the Platform is deemed a renewed representation that each of the foregoing remains true.
You acknowledge that any action taken by the Platform under this Section is taken to comply with applicable law, and that the Platform, its operators, affiliates, officers, employees, and agents shall have no liability whatsoever to you or any third party (including for any loss of value, missed opportunity, lost profits, or inability to access funds) for any such action taken in good faith.
You agree to indemnify the Platform on the terms set out in Section 11 with respect to any breach of this Section, and acknowledge that breach of this Section is a material breach of these Terms entitling the Platform to immediately terminate your access.
13. Termination
The Platform may suspend or terminate your access at any time, for any reason, with or without notice, including but not limited to violations of these Terms, suspected fraudulent activity, or compliance concerns. Upon termination, your right to use the Platform ceases immediately. Any fees paid prior to termination are non-refundable. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to indemnification, limitation of liability, and dispute resolution.
14. Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Platform, you consent to the practices described in the Privacy Policy.
15. Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English, and the arbitrator’s decision shall be final and binding.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
16. Modifications to Terms
The Platform reserves the right to modify these Terms at any time. Material changes will be communicated by updating the “Last updated” date at the top of this page and, where practicable, by providing notice through the Platform. Your continued use of the Platform after any changes constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
17. Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
